Before you apply for a trial of Alibaba Cloud CMH, read the relevant guidelines, rules, and procedures published on www.alibabacloud.com, as well as all the terms of service for the free trial of Alibaba Cloud CMH. Do not proceed if you do not agree on anything in this service or these terms of service, or cannot accurately understand the interpretation of Alibaba Cloud. After you activate this service for free and proceed with subsequent operations, you agree to these terms of service and the relevant guidelines, rules, and use processes published on http://www.alibabacloud.com. If you have any questions, submit a ticket. You may not invalidate or request to cancel these terms of service on the grounds of having failed to fully read and understand these terms, or having failed to receive answers to your questions from Alibaba Cloud.
General service terms
1. These terms of service form a valid contract between you and Alibaba Cloud on the basis of your use of Alibaba Cloud CMH. After you activate this service for free and proceed with subsequent operations, you agree to these terms of service.
2. You understand and agree that you use Alibaba Cloud CMH at your sole discretion (including but not limited to the compatibility between this service and your software and hardware products, such as the operating system and cloud server) and that you are fully liable thereof. You must read the corresponding service description on the Alibaba Cloud website before you use Alibaba Cloud CMH, and perform operations with caution in accordance with the relevant guidelines.
3. You understand and agree that you are responsible for backing up your business data involved in using Alibaba Cloud CMH.
4. You understand and acknowledge that during your use of Alibaba Cloud CMH, you must comply with the following rules:
4.1. You shall not engage in any behaviors that undermine or attempt to undermine network security. Such behaviors include but are not limited to phishing, hacker attacks, network fraud, injection of or suspected involvement in the spreading of viruses, Trojans, and malicious code to websites or cyberspace, and suspected involvement in attack behaviors, such as scanning, sniffing, ARP spoofing, and DDoS, against other websites and servers by using virtual servers.
4.2. You shall not modify or attempt to modify the system configurations provided by Alibaba Cloud or undermine the system and network security.
4.3. You shall not modify, translate, edit, lease, sublicense, transmit, or transfer on networks the software or services provided by Alibaba Cloud, and shall not obtain the source code of the software provided by Alibaba Cloud through reverse engineering, decompilation, or other methods.
4.4. You shall not copy, propagate, transfer, license, or provide Alibaba Cloud CMH for use to any third party without the prior written consent of Alibaba Cloud.
4.5. You shall not disseminate email advertisements or spam.
4.6. You shall not use Alibaba Cloud CMH in any way or for any purpose that violates national or local laws and regulations, industry practices, or public morality, or that affects or damages, or may affect or damage, the interests of Alibaba Cloud or Alibaba Group.
5. Limitation of and exemption from liability
You shall understand and agree to the fact that, although CMH provides support for service availability and reliability, Alibaba Cloud does not make a commitment on any service availability or reliability for the duration of the free trial. Alibaba Cloud shall not be liable for any work or consequences arising from your use of Alibaba Cloud CMH.
6. Changes and termination
6.1 You understand and acknowledge that Alibaba Cloud reserves the right to modify, cancel, or enhance one or more features of Alibaba Cloud CMH or the entire service at its discretion. Alibaba Cloud will inform you of any such modifications in advance by using methods such as publishing an announcement on the appropriate page on its website and sending a site notification. Alibaba Cloud also has the right to require you to use the latest version for any modified or enhanced feature of Alibaba Cloud CMH.
6.2. If you violate these terms of service or Alibaba Cloud considers that your use of Alibaba Cloud CMH does not meet the requirements of Alibaba Cloud, Alibaba Cloud reserves the right to suspend or terminate the service without notification. Specifically, if during your use of Alibaba Cloud CMH, you encounter computer viruses, network intrusions, and attacks including but not limited to DDoS attacks, or other events or behaviors (hereinafter referred to collectively as "other behaviors") that may undermine network security, produce an adverse impact on Alibaba Cloud, or affect the communication between Alibaba Cloud and the Internet, between Alibaba Cloud and specified networks or servers, or the internal communication of Alibaba Cloud. If your use of this service has caused losses to Alibaba Cloud, Alibaba Cloud reserves the right to claim compensation from you for such losses.
6.3. If the service is terminated in accordance with Article 6.1 and Article 6.2, Alibaba Cloud has the right to release your data, that is, release your created projects or requirements, and clear the data.
7. Confidentiality
You and Alibaba Cloud both shall be responsible for the confidentiality of the other party's confidential information, unless it is required by the state administration, judicial, and other competent organs or the information has entered the public domain.
8. Others
8.1. You understand and agree that Alibaba Cloud currently provides you with a free trial of Alibaba Cloud CMH. In other words, you do not have to pay Alibaba Cloud for the subscription to or use of Alibaba Cloud CMH. However, Alibaba Cloud does not rule out the possibility of charging fees in the future, and then Alibaba Cloud will publish the charging policy and specifications by posting an announcement or sending a site notice on the appropriate page of the website 10 calendar days in advance. If you continue to use CMH, you shall pay according to the valid charging policy and specifications and abide by the valid terms of service that Alibaba Cloud announces at that time. If you refuse to pay the service fees, Alibaba Cloud has the right not to provide you with this service and not to retain your business data.
8.2. Alibaba Cloud has the right to modify these terms of service at any time in accordance with changes to relevant laws and regulations, its business conditions, and its policy adjustments. The modified terms of service will be published on the Alibaba Cloud website (www.alibabacloud.com). If you disagree with the modification, you shall stop using Alibaba Cloud CMH. Your continued use of Alibaba Cloud CMH shall be deemed your acceptance of the modification to these terms of service.
8.3. If, for any reason whatsoever, any provision in these terms of service, in full or in part, is found to be invalid, unenforceable, or in violation of any applicable law, this provision is deemed to have been removed. However, the other provisions in these terms of service shall remain in full force and effect.
8.4. These terms of service shall be governed by the laws of the People's Republic of China. Any dispute arising in performing the terms of service shall be settled by both parties through consultation without delay. If no agreement can be reached, either party may file a lawsuit with the People's Court of Hangzhou's West Lake District.
