Our exempted services fall under Group G of the First Schedule, Service Tax Regulations 2018, item 8 as below:
"Provision of all types of information technology services excluding - (i) the provision or sales of goods in connection with the provision of the information technology; (ii) provision of information technology services in connection with - (A) goods or land situated outside Malaysia; (B) other than matters relating to (A) outside Malaysia."
We hereby confirm that the services supplied by our Company to our Clients are the exact same type of information technology services as provided by Alibaba Cloud (Malaysia) Sdn Bhd to us. We shall inform Alibaba Cloud (Malaysia) Sdn Bhd if there are changes that may revoke the eligibility for Service Tax Exemption pursuant to Service Tax (Persons Exempted from Payment of Tax) Order 2018. We agree that in any circumstances that Customs doesn't agree with this exemption due to a valid reason, Alibaba Cloud (Malaysia) Sdn Bhd may recover the exempted Service Tax amount from us in due course.
