:Shanghai ICP filing rules

When performing Internet content provider (ICP) filing, note that the filing rules and required documents may vary by province and municipality. This topic guides you through the filing process specific to Shanghai.

Enterprises or organizations

If the ICP filing entity is an enterprise or organization, you can understand the ICP filing regulations and prepare the required materials based on the following instructions:

  • Filing rules

    • Enterprises need to use their business license for ICP filing. The same business license can be used for multiple websites or apps filing, but it must be ensured that the information of the websites or apps being filed matches the filing entity information.

    • The entity leader of an ICP filing application must be the legal representative of the enterprise or organization. Otherwise, the application fails.

    • The responsible person of the website should be the legal representative; if not, an authorization letter from the legal representative is required.

    • Domains that have already obtained a filing number must have the website access service activated.

    • The validity period of the domain name must be greater than 6 months.

    • After the Internet information service with an ICP filing is launched, the ICP filing number must be displayed in the lower part of the Internet information service pages. In addition, the ICP filing number must be linked to the ICP filing platform of the Ministry of Industry and Information Technology (MIIT).

    • Effective 00:00:00 on January 1, 2018, all ICP filing applications for Internet information services are subject to mandatory domain name verification.

    • The domain holder can be consistent with the filing entity name, the legal representative name, or shareholders, in which case shareholders need to provide documents such as articles of association as proof.

    • An entity leader or Internet information service administrator can apply for an ICP filing only after the entity leader or Internet information service administrator reaches 14 years old.

  • Required documents

    • The entity identification document needs to be an original photo; colored copies or scanned images cannot be used for upload.

    • An electronic color photo of the original valid identity document of the entity leader, such as an electronic copy of the ID card.

    • An electronic color photo of the original valid identity document of the Internet information service administrator, such as an electronic copy of the ID card.

    • If the certificate type is an ID card, make sure that it is valid for more than three months.

    • (Optional) Electronic version of the authorization letter: If the responsible person of the website is not the legal representative, an authorization letter must be provided.

    • Facial verification of the responsible person of the website is required.

  • ICP filing process

    You must understand all the relevant information and make preparations for the ICP filing application. For more information, see Overview. After the preparations are complete, you can log on to the Alibaba Cloud ICP Filing system by using your PC, or you can log on to the Alibaba Cloud app by using your mobile phone to apply for an ICP filing.

  • Modify ICP filing information

    If you want to modify the entity information or Internet information service information after you have obtained an ICP filing number for your Internet information service, you can perform the operation based on the following regulations:

    • Enterprise ICP filings cannot be changed to individual ICP filings.

    • When changing the filing due to a change in the document number, you do not need to provide change materials.

    • If your enterprise or organization name changes, and you need to modify the ICP filing information, take note of the following regulations:

      • If the new enterprise or organization is not related to the original enterprise or organization, you must cancel the original ICP filing and apply for a new one. After you cancel your ICP filing, your Internet information service cannot be accessed. We recommend that you apply for a new ICP filing at the earliest opportunity.

      • If the new enterprise or organization is related to the original enterprise or organization, you must provide a certificate of change issued by the administration of industry and commerce. During the information change period, the Internet information service for which you have obtained an ICP filing number is not affected and can be accessed.

        Three types of certificates of changes are supported. If the ICP filing entity is an enterprise, you must apply for a certificate of change issued by the administration of industry and commerce. If the ICP filing entity is a public institution or government agency, you must provide an official letter issued by the senior department.

  • Add Alibaba Cloud to the ICP filing information as a service provider

    You may have obtained ICP filing numbers for the entity and domain name based on another service provider, but you want to change the service provider to Alibaba Cloud or add Alibaba Cloud as a new service provider. In this case, you can add Alibaba Cloud to the ICP information based on the following regulations:

    • The certificate number, entity leader information, domicile indicated in the identity documents, and mailing address must comply with the regulations of the local communications administration. Such information can be modified after Alibaba Cloud is added to the ICP filing information as a service provider.

    • The name of the enterprise or organization must be consistent with the original ICP filing information submitted to the MIIT. Otherwise, you must provide a certificate of change issued by the industry and commerce department. If you cannot provide a certificate of change, you must cancel the original ICP filing and apply for a new one.

Individuals

If the ICP filing entity is an individual, you can understand the ICP filing regulations and prepare the required materials based on the following instructions:

  • Filing rules

    • A temporary ID card cannot be used for filing. Hong Kong (China) and Macau (China) citizens should use their Mainland Travel Permit for filing.

    • Individuals under 16 years old are not allowed to perform ICP filing, and those aged 16 to 18 must provide proof of guardianship.

    • The address on the identification document must be in Shanghai; if not, a Shanghai residence permit or temporary residence permit must be uploaded.

    • Domains that have already obtained a filing number must be accessible, and the filing number must be displayed on the website, matching the actual filing number.

    • The validity period of the domain name must be greater than 6 months.

    • The domain holder must match the filing entity name, and if the domain has privacy protection enabled, it must be disabled during the filing process.

    • After the Internet information service with an ICP filing is launched, the ICP filing number must be displayed in the lower part of the Internet information service pages. In addition, the ICP filing number must be linked to the ICP filing platform of the Ministry of Industry and Information Technology (MIIT).

    • Effective 00:00:00 on January 1, 2018, all ICP filing applications for Internet information services are subject to mandatory domain name verification.

  • Required documents

    • An electronic copy of the residence permit, which is not required in all cases. If the identity documents are not issued by authorities in the local province, autonomous region, or municipality, you must upload a residence permit.

    • An electronic copy of the original valid identity document of the individual, such as a color photo of the original ID card. If the certificate type is an ID card, make sure that it is valid for more than three months.

    • Facial verification of the responsible person of the website is required.

  • ICP filing process

    You must understand all the relevant information and make preparations for the ICP filing application. For more information, see Overview. After the preparations are complete, you can log on to the Alibaba Cloud ICP Filing system by using your PC, or you can log on to the Alibaba Cloud app by using your mobile phone to apply for an ICP filing.

  • Modify ICP filing information

    If you want to modify the entity information or Internet information service information after you have obtained an ICP filing number for your Internet information service, you can perform the operation based on the following regulations:

    An individual filing cannot be changed to another individual. However, if the individual who has successfully completed the filing is the legal representative of an organization, the filing can be changed from an individual filing to an organizational filing.

  • Add Alibaba Cloud to the ICP filing information as a service provider

    You may have obtained ICP filing numbers for the entity and domain name based on another service provider, but you want to change the service provider to Alibaba Cloud or add Alibaba Cloud as a new service provider. In this case, you can add Alibaba Cloud to the ICP information based on the following regulations:

    • The name of the ICP filing entity and the certificate number must be consistent with the original ICP filing information submitted to the MIIT. Otherwise, you must first modify the ICP filing information at the original service provider, or cancel the original ICP filing and apply for a new one.

    • The mailing address must comply with the regulations of the local communications administration. Such information can be modified after Alibaba Cloud is added to the ICP filing information as a service provider.
