API Terms of Use

  1. API

    For the purpose of these Terms, an “API” refers to an Application Programming Interface (hereinafter referred to as “API”) provided by Alibaba Cloud. After programming, you can use the APIs to acquire Elastic Computing Service (ECS), Relational Database Service (RDS), Open Storage Service (OSS) and other cloud services that were launched by Alibaba Cloud to meet its evolving business plan as well as the customer’s programming needs.

  2. API Usage

    2.1 Alibaba Cloud has the right to decide your eligibility to be granted the API usage license at its sole discretion. After Alibaba Cloud permits you to create an AccessKey, you are granted a royalty-free, non-transferable, non-sublicensable, and non-exclusive API usage license that allows you to acquire Alibaba Cloud’s cloud services by means of API.

    2.2 You understand and agree that the Alibaba Cloud services that you acquire by means of API shall be used in compliance with the applicable agreement for such services. (Visit the sites listed at the bottom of this page for more information.)

    2.3 The number of your visits to Alibaba Cloud APIs and the size of data generated therefrom shall not exceed the limits specified by Alibaba Cloud. In the event that Alibaba Cloud discovers you attempt to exceed or bypass the limits, your APIs will be blocked temporarily or permanently.

    2.4 You understand and agree that Alibaba Cloud only provides the APIs, and you shall compile the programs to call Alibaba Cloud services as per your needs. Alibaba Cloud shall not be held liable for any consequences arising from your programming process or the usage of your programs.

    2.5 In the use of Alibaba Cloud APIs, you shall not:

    2.5.1 Modify, translate, edit, lease, sublicense, or transmit/transfer on any information media any API from Alibaba Cloud, or obtain the source code of any API from Alibaba Cloud by means of reverse engineering, decompilation, or other methods (unless explicitly permitted by Alibaba Cloud);

    2.5.2 Conduct any activity that undermines or attempts to undermine network security (including but not limited to phishing, hacker attacks, network fraud, injection of or suspected involvement in the spreading of viruses, trojans, and malicious codes in websites or cyberspace, or suspected involvement in attacks against other websites and servers by using virtual servers, such as scanning, sniffing, ARP spoofing, and DoS);

    2.5.3 Conduct any activity that changes or attempts to change the system configurations provided by Alibaba Cloud or undermines network security;

    2.5.4 Conduct any activity that violates these Terms, other applicable agreement between you and Alibaba Cloud, the regulations and announcements presented by Alibaba Cloud with respect to the APIs on relevant pages, or that infringes the rights of Alibaba Cloud or any third party;

    2.5.5 Conduct any other activity that is against applicable laws and regulations.

    2.6 You understand and agree that Alibaba Cloud reserves the right to release future API versions and require you to acquire and use the latest version.

    2.7 In the event that it is necessary to suspend your use of the APIs for the purpose of maintaining or upgrading any server or system of Alibaba Cloud, Alibaba Cloud will make every reasonable effort to notify you in advance by publishing notice on Alibaba Cloud International Website.

    2.8 Refer to the records in the Alibaba Cloud background for the statistics on the calls you made to services by means of API.

  3. DISCLAIMER

    YOU UNDERSTAND AND AGREE THAT ALIBABA CLOUD PROVIDE THE API AS IS, AND ALIBABA CLOUD MAKES NO WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO THE API. YOUR USE OF ALIBABA CLOUD APIS IS MADE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BEAR ALL THE LOSSES ARISING THEREFROM.

  4. Termination

    Without prejudice and in addition to its rights and remedies at law or equity, Alibaba Cloud may suspend or terminate your use of APIs, or restrict your right to the use of APIs, immediately upon notice to you, if in the sole opinion of Alibaba Cloud, you or your end users have engaged of any of the following:

    4.1 breached this Terms of Use or applicable agreement between you and Alibaba Cloud;

    4.2 used the APIs or Alibaba Cloud services in a way that poses a security or system stability risk to the Alibaba Cloud Platform or any third party;

    4.3 used the APIs or Alibaba Cloud Services in a way that subjects, or will subject, Alibaba Cloud or its affiliates to liability;

    4.4 engaged in any fraudulent, deceptive or unlawful act; or4.5 become the subject of any bankruptcy, reorganization, liquidation, dissolution or similar proceedings.

  5. Miscellaneous

    5.1 By using Alibaba Cloud APIs, you acknowledge that you are obliged to comply with these Terms. Alibaba Cloud reserves the right to modify these Terms at any time without prior notice to you. In the event of any change to these Terms, Alibaba Cloud will post the modified Terms on the Alibaba Cloud website at www.alibabacloud.com. You understand and agree that your use of the API service after these Terms are modified constitutes your agreement to the modified Terms. If you do not agree to such modification, you shall stop using the APIs.

    5.2 Currently, Alibaba Cloud provides you with the APIs at no cost. This does not exclude the possibility that Alibaba Cloud will charge a fee in the future, by which time Alibaba Cloud will publish the billing policies and rules by making an announcement on its website or issuing a notice on an appropriate page of its website. If you still need to use Alibaba Cloud APIs after the free trial period ends, you shall pay the service fee according to the billing policies and rules then published by Alibaba Cloud and follow the terms, standards, and procedures for API usage that are effective then.

    5.3 This Agreement shall be governed by the laws of Singapore without regard to its conflict of law provisions. The parties to the Terms hereby submit to the exclusive jurisdiction of the courts of Singapore.
