ICP Filing:ICP filing regulations for Shanghai

Regulations for Internet content provider (ICP) filing and the materials required to apply for an ICP filing vary based on the communications administration in each province, autonomous region, or municipality. This topic describes the ICP filing regulations of the communications administration in Shanghai.

Enterprises or organizations

If the ICP filing entity is an enterprise or organization, you can understand the ICP filing regulations and prepare the required materials based on the following instructions:

  • Important regulations

    • Enterprises and organizations must present a valid business license to apply for ICP filings.

    • The entity leader of an ICP filing application must be the legal representative of the enterprise or organization. Otherwise, the application fails.
    • The website administrator must be the legal representative of the enterprise or organization. Otherwise, an electronic copy of a letter of authorization from the legal representative must be provided.

    • If you have obtained an ICP number for a domain name, you must use the domain name to provide website services.

    • The domain name must be valid for more than six months.

    • After the website is launched, the ICP filing number must be displayed in the lower part of the website pages. In addition, the ICP filing number must be linked to the ICP filing platform of the Ministry of Industry and Information Technology (MIIT).
    • From 00:00:00 on January 1, 2018, the relevant authorities started to perform domain name verification for all submitted ICP filing applications.
    • The name of the domain name registrant must be consistent with the name of the ICP filing entity (including shareholders) or the name of the legal representative of the enterprise or organization. Shareholders must provide proof materials such as the articles of association.

    • An entity leader or website administrator can apply for an ICP filing only after the entity leader or website administrator reaches 14 years old.
  • Required materials

    • An electronic photo of an effective certificate that belongs to the ICP filing entity, rather than a color printed copy or a scanned copy.

    • An electronic color photo of the original valid identity document of the entity leader, such as an electronic copy of the ID card.
    • An electronic color photo of the original valid identity document of the website administrator, such as an electronic copy of the ID card.
    • If the certificate type is an ID card, make sure that it is valid for more than three months.
    • Electronic copy of a letter of authorization: optional. If the website administrator is not the legal representative, an electronic copy of a letter of authorization from the legal representative must be provided.

    • The website administrator must perform facial recognition for identity verification.

  • Procedure for applying for an ICP filing

    You must understand all the relevant information and make preparations for the ICP filing application. For more information, see Overview. After the preparations are complete, you can log on to the Alibaba Cloud ICP Filing system by using your on-premises machine, or you can log on to the Alibaba Cloud app by using your mobile phone to apply for an ICP filing.

  • Regulations for modifying ICP filing information

    If you want to modify the entity information or website information after you have obtained an ICP filing number for your website, you can perform the operation based on the following regulations:

    • Enterprise ICP filings cannot be changed to individual ICP filings.
    • If the number of a provided document changes, no certificate of change is required when you modify the ICP filing information.

    • If your enterprise or organization name changes, and you need to modify the ICP filing information, take note of the following regulations:
      • If the new enterprise or organization is not related to the original enterprise or organization, you must cancel the original ICP filing and apply for a new one. After you cancel your ICP filing, your website cannot be accessed. We recommend that you apply for a new ICP filing at the earliest opportunity.
      • If the new enterprise or organization is related to the original enterprise or organization, you must provide a certificate of change issued by the administration of industry and commerce. During the information change period, the website for which you have obtained an ICP filing number is not affected and can be accessed.

        Three types of certificates of changes are supported. If the ICP filing entity is an enterprise, you must apply for a certificate of change issued by the administration of industry and commerce. If the ICP filing entity is a public institution or government agency, you must provide an official letter issued by the senior department.

  • Regulations for adding Alibaba Cloud to the ICP filing information as a service provider

    You may have obtained ICP filing numbers for the entity and domain name based on another service provider, but you want to change the service provider to Alibaba Cloud or add Alibaba Cloud as a new service provider. In this case, you can add Alibaba Cloud to the ICP information based on the following regulations:

    • The certificate number, entity leader information, domicile indicated in the identity documents, and mailing address must comply with the regulations of the local communications administration. Such information can be modified after Alibaba Cloud is added to the ICP filing information as a service provider.
    • The name of the enterprise or organization must be consistent with the original ICP filing information submitted to the MIIT. Otherwise, you must provide a certificate of change issued by the administration of industry and commerce. If you cannot provide a certificate of change, you must cancel the original ICP filing and apply for a new one.

Individuals

If the ICP filing entity is an individual, you can understand the ICP filing regulations and prepare the required materials based on the following instructions:

  • Important regulations

    • A temporary ID card cannot be used to apply for an ICP filing. Residents of Hong Kong (China) and Macao (China) can use the Mainland Travel Permits for Hong Kong and Macao Residents to apply for ICP filings.

    • An individual must be at least 16 years old to apply for an ICP filing. An individual who is at the age of 16 to 18 must provide proof of guardianship.

    • The domicile indicated in your identity document must be in Shanghai. Otherwise, you must upload an electronic copy of a temporary residence permit or permanent residence permit of Shanghai.

    • If you have obtained an ICP number for a domain name, you must use the domain name to provide website services. The ICP number must be displayed in the lower part of website pages and consistent with the actual ICP filing information.

    • The domain name must be valid for more than six months.

    • The name of the domain name registrant must be consistent with that of the ICP filing entity. If the privacy protection feature is enabled for the domain name, the feature must be disabled before the ICP filing application.

    • After the website is launched, the ICP filing number must be displayed in the lower part of the website pages. In addition, the ICP filing number must be linked to the ICP filing platform of the Ministry of Industry and Information Technology (MIIT).
    • From 00:00:00 on January 1, 2018, the relevant authorities started to perform domain name verification for all submitted ICP filing applications.
  • Required materials

    • An electronic copy of the residence permit, which is not required in all cases. If the identity documents are not issued by authorities in the local province, autonomous region, or municipality, you must upload a residence permit.
    • An electronic copy of the original valid identity document of the individual, such as a color photo of the original ID card. If the certificate type is an ID card, make sure that it is valid for more than three months.
    • The website administrator must perform facial recognition for identity verification.

  • Procedure for applying for an ICP filing

    If you want to modify the entity information or website information after you have obtained an ICP filing number for your website, you can perform the operation based on the following regulations:

    The ICP filing of an individual cannot be changed to that of another individual. If an individual who has obtained an ICP filing is the legal representative of an enterprise or organization, the individual ICP filing can be changed to an ICP filing of the enterprise or organization.

  • Regulations for adding Alibaba Cloud to the ICP filing information as a service provider

    You may have obtained ICP filing numbers for the entity and domain name based on another service provider, but you want to change the service provider to Alibaba Cloud or add Alibaba Cloud as a new service provider. In this case, you can add Alibaba Cloud to the ICP information based on the following regulations:

    • The name of the ICP filing entity and the certificate number must be consistent with the original ICP filing information submitted to the MIIT. Otherwise, you must first modify the ICP filing information at the original service provider, or cancel the original ICP filing and apply for a new one.
    • The mailing address must comply with the regulations of the local communications administration. Such information can be modified after Alibaba Cloud is added to the ICP filing information as a service provider.
