:Alibaba Cloud’s Policy on Intellectual Property Rights Protection

Alibaba Cloud respects intellectual property rights (“IPRs”) and attaches great importance to IPR protection. Alibaba Cloud has thus established following policy in accordance with relevant laws and regulations for considering notifications of trademark and/or copyright violations. Please follow the process in this policy to submit notifications of trademark and/or copyright violations.

1. Trademark and/or Copyright Violations

This policy is for reporting copyright or trademark violations on Alibaba Cloud international products and/or services.

For domain name disputes claims, please refer to the Uniform Domain Name Dispute Resolution Policy (the “UDRP”) if you have a concern or dispute about a registered domain name. Any dispute regarding the registration of domain names will need to be sent either to the registrant or an ICANN-approved arbitration provider, or the court system. This policy specifically excludes domain name disputes and has been established to allow reporting of possible violations involving other Alibaba Cloud products and services.

2. Portals for Reporting Trademark and Copyright Violations

Alibaba Cloud maintains an online form where you may submit notifications of trademark and/or copyright violations. Please visit by referring to the below link and fill in the online form accordingly.

While using the above online form is the fastest and easiest way to notify us, you may also send notifications of trademark and copyright violations containing a complete set of information/documents described in Section 3 as below by email to ipr-aliyun@alibaba-inc.com.

3. Report Trademark and Copyright Violations

We require sufficient information in order to review and determine any proper response or action, if any. Accordingly, if you do not provide us with all the required information, including the alleged violation of law or regulation for the applicable jurisdiction(s) and supporting documents to substantiate the alleged unlawful activity, Alibaba Cloud may, at its sole discretion and without any legal obligations to do so, contact you for further information. Without sufficient documents to substantiate the alleged unlawful activity, Alibaba Cloud reserves the right to not take any action or reject your complaint. Please note that we reserve the right to refuse to open or process any suspicious or potentially harmful attachments or emails. We will not take any action either if the products or services that are the subject of your notification (such as domain names or websites) have been suspended during our investigation.

To be considered effective, a notification of trademark and/or copyright violation shall include the following information:

(1) Your Identity Information

- Please provide your full name/company name, country, address and contact email address (in providing contact information, please keep in mind that Alibaba Cloud may forward the infringement notices and relevant information to the reported user);

- If you are representing rights holders, you must have the legal authority to act on their behalf;

(2) Identify Your Trademark and/or Copyright

- For trademark violations, please identify the trademark(s) that is claimed to be infringed, the country where it is registered, the registration number and the goods and/or services covered by or offered under the mark identified above;

- For copyright violations, please identify and describe the copyrighted work on which your notification is based, and please provide an example of the copyrighted work, such as an URL or a screenshot where the copyrighted work can be viewed;

(3) Identify the Alleged Violation

- Please identify the type of violation you are reporting;

- Please identify the service(s) provided by Alibaba Cloud to the reported website and the specific domain name or IP address of the reported website;

- Please identify the specific location (URL) of the reported website, or content on the website, where your trademark or copyright is being infringed;

- Please describe why you believe the reported website infringes your trademark and/or copyright;

(4) Statement

Please also include a good-faith statement, signed under penalty of perjury, stating as follows:

i. The information in the notification is true, accurate and complete, and under penalty of perjury, that the Notification Party is the owner, or is authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed;

ii. The Notification Party shall indemnify and compensate Alibaba Cloud for any loss (including but not limited to the losses result from Alibaba Cloud's compensation to the reported user or other entities, and the damages to Alibaba Cloud's reputation and goodwill, etc.) directly or indirectly caused by false, inaccurate and incomplete materials that the Notification Party submitted, and shall fully indemnify and hold Alibaba Cloud harmless against any claims or liabilities arising therefrom.

If you are filing copyright infringement notices under the DMCA, please submit infringement notices in accordance with the requirements of the DMCA.

In order to effectively handle IPR complaints, Alibaba Cloud may forward the infringement notices and relevant information submitted by you to the reported user. By submitting a notification to Alibaba Cloud, it means that you have irrevocably authorized Alibaba Cloud to disclose such information to the reported user including your contact details.

Please note that Alibaba Cloud does not control or determine the content of Alibaba Cloud customers or their end users. Upon receipt of appropriate notification pursuant to the above, Alibaba Cloud will take action expeditiously including forwarding the written notification to the reported user and requiring them to remove or disable access to the infringing content or directly contact you to resolve the dispute.

Where the reported user fails to comply with our policies and Terms of Use, Alibaba Cloud, at its sole discretion and without any legal obligation to do so, reserves the right to take appropriate action, including but not limited to locking down the domain name(s), disabling access to the reported website, and/or suspending or terminating the user’s account.

4. Counter-notification

If the reported user believes that the notification of trademark or copyright violation is incorrect or that they have the right to use the material at issue, they may reach out to you directly to resolve the issue or they may send a counter-notification to Alibaba Cloud. If we receive a counter-notification, we may forward it to you. For any objection to the counter-notification materials of the reported user, you are recommended to directly reach out to the user to resolve the dispute or seek legal remedies. Alternatively, if you have new evidence against the counter-notification provided by the reported user, you may also send the same to Alibaba Cloud, and we may forward the additional documents to the reported user.

5. Repeat Infringers

Alibaba Cloud terminates the accounts of repeated infringers in appropriate circumstances.
