Before you perform cross-border data migration, such as transferring data out of the Chinese mainland or between different countries or regions, review the relevant compliance statements. Failure to comply may cause the migration to fail and result in legal liability.
Compliance statement
Cross-border data migration involves transmitting your cloud business data to a specified region. These operations must comply with the following requirements:
You must have legal permission to process the relevant cloud business data.
You must use adequate data security technologies and management measures.
You must ensure that the data transmission complies with applicable laws and regulations. For example, the transmitted data must not contain any content that is explicitly restricted or prohibited from transmission or disclosure by law.
Important notice from Alibaba Cloud: If a data migration operation may involve cross-border transmission, consult with legal or compliance professionals before you perform the operation. Ensure that the cross-border data transmission complies with relevant laws, regulations, and regulatory requirements. These requirements include but are not limited to fulfilling legal obligations such as obtaining valid authorization from personal information subjects, signing and filing contracts, and passing required security assessments.
Parties that perform cross-border data migration in violation of this compliance statement are responsible for the resulting legal consequences. If this non-compliance causes a loss to Alibaba Cloud or its affiliated companies, those parties are liable for compensation in accordance with the law.
