Alibaba Cloud Developer Forums RulesAlibaba Cloud Developer Forums Rules Version: Nov. 2015 These rules (“Rules”) set out the terms of use for the Alibaba Cloud Developer Forums operated by Alibaba Cloud Computing Limited (“Alibaba Cloud”, “we”, “us”, “our”). The Forum is an open community for developers all over the world to share their expertise and exchange their ideas freely, as well as a place to learn about the cloud computing industry and Alibaba Cloud. The development of cloud computing relies on you, the users, and you are encouraged to use the Forum to share knowledge, techniques and experience in a technique focused, productive and positive environment. By using the Forum or posting any material to the Forum, you signify your agreement to (i) these Rules; (ii) the Privacy Policy and Terms of Use applicable to the Alibaba Cloud International Website, currently located at URL: https://intl.aliyun.com, or such other URL(s) as may be designated from time to time (“Alibaba Cloud Platform”), incorporated herein by reference, and (iii) any other terms and policies applicable to the Alibaba Cloud Platform which we may publish from time to time.. Forum The members of the Alibaba Cloud Platform are entitled to participate in the Forum. If you have not logged in to the Alibaba Cloud Platform for a period of six (6) months or more, we reserve the right to suspend or terminate your account and remove your posts in the Forum. The rules laid out below apply to anyone participating in the Forum. Submission of Posts Please note that your posts may not be anonymous and we do not guarantee any confidentiality with respect to any posts you submit. Before posting any materials on the Forum, you must register for an account on the Alibaba Cloud Platform. You are solely responsible for all posts published by you on the Forum and the consequences of submitting and publishing your post on the Forum. Alibaba Cloud reserves the right to remove any material or posts you make on the Forum if, in our opinion, such material does not comply with our content standards. Alibaba Cloud does not endorse any post submitted to the Forum by you, or any opinion, recommendation, or advice expressed therein, and Alibaba Cloud expressly disclaims any and all liability in connection with any post submitted by you. Moderation We are under no obligation to you or any other person to oversee, monitor or moderate the Forum or any other service we provide on our site or any other site and we may therefore stop moderating the forums at any time. We reserve the right to remove, or to disable access to, any posts which we deem to be potentially defamatory of any person, or otherwise inappropriate, or which we deem unlawful or in violation of any third party rights. We expressly exclude liability for any loss or damage arising from the use of the Forum by any person. License By posting any material to the Forum, you agree to grant Alibaba Cloud, and any other company or corporation within the Alibaba Group, a non-exclusive license to use that post. Although you will still own the copyright to your post, we will have the right to freely use, edit, alter, reproduce, publish, translate, create derivative works from, display such content throughout the world in any media and/or distribute the material contained in your post. This license will be free of charge, perpetual, irrevocable and fully capable of sub-license. You grant Alibaba Cloud and any other company or corporation within the Alibaba Group the right to use the name that you submit in connection with such post, if they choose. By submitting your post to the Forum, you further affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the posts you submit and grant Alibaba Cloud the non-exclusive license described above and that your post does not infringe any third party rights (including third party intellectual property rights). If you are not in a position to grant such a licence to us, please do not post any materials to the Forum. You and third parties may be permitted to upload certain software (including machine images), data, text, audio, video, images or other content (“Third Party Content”) to the Forum. You acknowledge that (i) Alibaba Cloud has not tested or screened Third Party Content, (ii) your use of any Third Party Content is at your sole risk, and (iii) any Third Party Content may be subject to separate license terms as determined by the person posting such content. Content Standards The content standards below must be complied with in spirit as well as to the letter. We will determine, at our discretion, whether a post breaches the content standards. A post must be accurate (where it states facts), be genuinely held (where it states opinions), comply with all -the applicable laws applicable in the country from which it is posted, and be relevant. A post must NOT: · be defamatory of any person; · be obscene, offensive, hateful or inflammatory; · promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; · disclose the name, address, telephone, mobile or fax number, e-mail address or any other personal data in respect of any individual; · infringe any copyright, database right or trademark of any other person; · breach any legal duty owed to a third party, such as a contractual duty or a duty of confide · be in contempt of court; · be likely to harass, upset, embarrass, alarm or annoy any other person; · impersonate any person, or misrepresent your identity or affiliation with any person; · give the impression that the post emanates from Alibaba Cloud if this is not the case; · advocate, promote, or incite any third party to commit, or assist, any unlawful or criminal act; · contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public for whom the statement is intended are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism; and · contain any advertising or promote any services or web links to other sites. Breach of These Rules If we consider that a breach of the content standards as set out above has occurred, we may at our discretion take such action as we deem appropriate, including but without limitation, all or any of the following actions: · immediate, temporary or permanent withdrawal of your right to use the Forum; · immediate, temporary or permanent removal of any posts already posted on the Forum; · issuance of a warning to you; · legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; · further legal action against you; and · disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law. We exclude liability for all action we may take in response to breaches of these Rules. Use of Forum You understand that when using the Forum, you will be exposed to information from a variety of sources, and that Alibaba Cloud is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such information. You further understand and acknowledge that you may be exposed to information that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Alibaba Cloud with respect thereto. Indemnity You hereby agree to indemnify and hold Alibaba Cloud, its respective affiliates, directors, officers and employees harmless from and against any and all losses, claims, liabilities which may arise from your use of or access to the Forum or from your breach of any of these Rules. You hereby further agree to indemnify and hold Alibaba Cloud, its affiliates, directors, officers and employees harmless, from and against any and all losses, damages, claims, liabilities (including legal costs on a full indemnity basis) which may arise, directly or indirectly, as a result of any claims asserted by any third party claimants or other any third parties relating to any posts you submit to the Forum. You hereby further agree that Alibaba Cloud is not responsible and shall have no liability to you, for any material posted to the Forum by you or any other users, including defamatory, offensive or illicit material and that the risk of damages from such material rests entirely with you. Alibaba Cloud reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate with Alibaba Cloud in asserting any available defenses and indemnify and hold Alibaba Cloud harmless against the reasonable legal fees incurred by Alibaba Cloud in that regard. Changes to Forum Rules Alibaba Cloud may revise these Rules at any time. Please therefore check this page from time to time to be updated of any changes we may make as they are legally binding on you. Alibaba Cloud assumes no liability or responsibility for notifying changes of these Rules to any users. Once posted on this page, the new Rules will become immediately effective.
